By placing an order, enrolling in a subscription, or booking event services with Lushie Blooms, you agree to the following Terms & Conditions. Please read them carefully prior to purchase or booking.
1. GENERAL TERMS
Lushie Blooms provides custom floral arrangements, subscription services, and event-based floral design services. All services are subject to availability and acceptance. By placing an order or engaging services, the client agrees to be bound by these Terms & Conditions in full.
2. CUSTOM & MADE-TO-ORDER DESIGNS
All floral designs are custom and made to order. Due to the natural and seasonal nature of flowers, exact flower varieties, colors, sizes, and compositions cannot be guaranteed.
Images shown on the website, social media, or marketing materials are representative of style only and are not a guarantee of exact replication.
3. SUBSTITUTIONS & AVAILABILITY
Lushie Blooms reserves the right to substitute flowers, vessels, or materials due to availability, seasonality, weather conditions, or market fluctuations. Substitutions will be made with items of equal or greater value, while maintaining overall design integrity and aesthetic.
4. DESIGNER’S CHOICE ORDERS
Designer’s Choice arrangements are created at the sole creative discretion of Lushie Blooms, based on availability and design judgment at the time of creation. By selecting Designer’s Choice, the client acknowledges that the final arrangement is an artistic interpretation and may vary significantly from examples shown.
5. SUBSCRIPTION SERVICES
Subscription arrangements are provided on a recurring basis according to the schedule selected at checkout.
Subscriptions require a minimum commitment of two (2) deliveries. The initial two deliveries are non-cancelable and non-refundable once the subscription has been activated.
Subscription contents may vary with each delivery. Specific flower varieties, colors, vessels, or designs are not guaranteed.
Subscriptions may be modified, paused, or canceled only after the minimum two (2) deliveries have been completed, and must be requested in writing prior to the next billing cycle, subject to cutoff timelines communicated at purchase.
Once a subscription delivery has been prepared or flowers have been sourced, that delivery is non-refundable, regardless of subsequent cancellation requests.
Lushie Blooms reserves the right to adjust pricing, delivery schedules, or availability with reasonable notice.
6. PAYMENT AUTHORIZATION & FAILED PAYMENTS (SUBSCRIPTIONS)
By enrolling in a subscription, the client authorizes automatic recurring charges to the payment method on file for each scheduled delivery.
If a payment fails, is declined, or cannot be processed for any reason, Lushie Blooms reserves the right to pause or cancel the subscription without fulfilling the affected delivery. The client remains financially responsible for any outstanding balance, including the required minimum two (2) delivery commitment.
Lushie Blooms is not responsible for missed deliveries due to failed or late payments and is under no obligation to reschedule or refund affected deliveries.
7. EVENT FLORAL SERVICES
Event services (including weddings, installations, brand activations, and private events) require a separate proposal, contract, or invoice, which may include additional terms.
Unless otherwise stated in writing:
Event florals are custom, perishable, and non-refundable
Design changes are subject to availability and may incur additional fees
Setup, installation, and strike times are estimated and not guaranteed
Lushie Blooms is not responsible for delays caused by venue access, weather, vendor coordination, or client-provided timelines
Once installation is complete, responsibility for the florals transfers to the client.
8. RENTALS & EVENT DAMAGE
Any rented items (including but not limited to vessels, structures, stands, candles, or hardware) remain the property of Lushie Blooms.
The client assumes responsibility for loss, theft, or damage to rental items beyond normal wear and tear. Replacement or repair costs may be charged accordingly.
9. PET & ANIMAL SAFETY DISCLAIMER
Certain flowers and plants may be toxic or harmful to pets or animals if ingested or handled. Lushie Blooms does not guarantee pet-safe arrangements unless explicitly stated in writing.
Lushie Blooms assumes no responsibility or liability for injury, illness, or death of pets or animals resulting from exposure to floral arrangements. Responsibility for pet safety rests entirely with the client and/or recipient.
10. ALLERGY DISCLAIMER
Lushie Blooms is not responsible for allergic reactions caused by flowers, plants, pollen, or related materials. Clients assume all responsibility for managing sensitivities or allergies.
11. PRICING & PAYMENT
All prices are listed in USD. Full payment is required prior to fulfillment unless otherwise agreed in writing. Event bookings may require deposits, progress payments, or final balances as outlined in the event proposal or invoice.
12. CANCELLATIONS, RETURNS & REPLACEMENTS
Due to the custom, made-to-order, and perishable nature of floral products, returns are not accepted and all sales are final.
If the client is dissatisfied due to a verifiable quality issue, the client must contact Lushie Blooms within twenty-four (24) hours of delivery and provide clear details and photographic documentation. Lushie Blooms will review the information and, at its sole discretion, determine whether a quality issue exists.
If a quality issue is confirmed, Lushie Blooms may offer a replacement arrangement of comparable value. Refunds are not offered under any circumstances.
Replacements will not be issued based on design preferences, subjective taste, color expectations, stylistic interpretation, or perceived size differences when the arrangement aligns with the agreed-upon order type and style, including Designer’s Choice.
Subscription services remain subject to the minimum delivery commitment outlined in Section 5.
13. DELIVERY & PICKUP
Delivery times are estimated windows, not guaranteed times. Lushie Blooms is not responsible for delays due to traffic, weather, access issues, or recipient unavailability.
Once delivered or installed, responsibility transfers to the client or recipient.
14. PRODUCT CARE & LIFESPAN GUARANTEE
Flowers are natural, perishable products with varying lifespans influenced by environment, handling, and care.
When properly cared for, Lushie Blooms guarantees that floral arrangements will remain presentable for a minimum of seventy-two (72) hours from the delivery date.
Proper care includes, but is not limited to, adherence to standard floral care practices, including adequate hydration, routine stem maintenance, avoidance of direct sunlight, heat sources, drafts, and proximity to ripening fruit, and maintenance of suitable indoor conditions.
This guarantee does not apply in cases of improper care, extreme temperatures, delayed delivery access, relocation after delivery, or other conditions beyond Lushie Blooms’ control.
Any concerns regarding longevity must be reported within the twenty-four (24) hour timeframe outlined in Section 12 and are subject to the replacement-only remedy described therein. No refunds will be issued.
15. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Lushie Blooms shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase, use, or handling of floral arrangements or services.
Total liability, if any, shall not exceed the total amount paid for the applicable order or service.
16. FORCE MAJEURE
Lushie Blooms shall not be liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather, supply chain disruptions, labor shortages, transportation interruptions, venue restrictions, governmental actions, or other unforeseen circumstances beyond Lushie Blooms’ control.
17. INTELLECTUAL PROPERTY
All designs, images, text, and content created by Lushie Blooms remain the intellectual property of Lushie Blooms and may not be copied, reproduced, or used without written permission.
18. GOVERNING LAW
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
19. ACCEPTANCE OF TERMS
By placing an order, enrolling in a subscription, or booking event services with Lushie Blooms, the client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
